Traffic Accident in Kayseri
The accident occurred on September 23rd last year, at around 17:00 on Erkilet Boulevard in Ertuğrulgazi Neighborhood, Kocasinan district. The car with the license plate 38 HP 039, driven by Mustafa Ö., who lives in the Netherlands, hit Furkan Aydeniz, who was trying to cross the road on his bicycle. Aydeniz was injured in the accident. Police and medical teams were dispatched to the scene of the accident after people in the area reported it. Furkan Aydeniz, who was taken to Kayseri City Hospital by ambulance, could not be saved.
Mustafa Ö., who was detained, was released on probation. A lawsuit was filed against Mustafa Ö. at the Kayseri 7th Criminal Court of First Instance, requesting a prison sentence of 2 to 6 years for the crime of “murder by negligence.” The court ruled that Mustafa Ö., who had a foreign driver’s license, be confiscated for 6 months.
In the expert report given by the driver Mustafa Ö., it was stated that “he was driving fast in a residential area where the speed limit was 50 kilometers and while approaching an uncontrolled 4-way intersection, he approached the intersection without reducing his vehicle’s speed, and the stopping point before and after the collision was 72.5 meters.
Decision Hearing : While the defendant Mustafa Ö., who was not arrested, did not attend the final hearing of the case, the father of the deceased Aydeniz, Osman Aydeniz, who filed the complaint, and the lawyers of the parties were present in the courtroom. The court judge ruled the defendant Mustafa Ö. to 3 years in prison for the crime of “causing death by negligence”. The judge reduced the sentence to 2.5 years by applying a “good behavior” reduction to the defendant, and ruled that his foreign driver’s license be confiscated for 6 months.
Furkan’s father, Osman Aydeniz, reacted to the decision and said, “We will appeal. We believe that a good decision will be made during the appeal process. We do not want to lose our faith in justice.”
