President Biden is actively exploring legislative measures that would bring significant changes to the Supreme Court. One of the proposals under consideration involves implementing term limits and a code of ethics that would be binding on the justices.

The unveiling of Mr. Biden’s potential overhaul plans for the court is expected in the near future. However, it is important to note that these proposals would require approval from Congress. Given the current Republican control of the House and the slim Democratic majority in the Senate, obtaining such approval may prove to be a challenging task.

Additionally, the president is contemplating the idea of proposing a constitutional amendment that could restrict the broad presidential immunity supported by the conservative majority of the Supreme Court in a recent ruling. Mr. Biden has criticized this ruling, labeling it as a “dangerous precedent” that could potentially grant presidents unchecked powers.

Nevertheless, the path to amending the Constitution is demanding, as it necessitates two-thirds of votes in Congress or in a convention organized by two-thirds of the states. Subsequently, the proposed amendment would need to be ratified by three-fourths of state legislatures.

During a virtual meeting with members of the Congressional Progressive Caucus, President Biden hinted at his intentions to make changes to the court without divulging specific details. He acknowledged the importance of collaboration with the caucus, indicating that he is on the brink of introducing a major initiative to reshape the court and its functions.

As the deliberations continue behind closed doors, the potential reforms to the Supreme Court could have far-reaching implications on the future of the judiciary system in the United States.
