A state grand jury in Arizona, which charged 18 individuals earlier this spring in a scheme aimed at overturning Donald J. Trump’s 2020 election loss, revealed in recently unsealed court documents that they had contemplated indicting him as well. These documents, released on Tuesday, shed light on the grand jury’s deliberations and the role of prosecutors in their decision-making process.

According to the filings from the Arizona attorney general’s office, prosecutors recommended against charging Mr. Trump, citing a longstanding Justice Department policy that advises against pursuing state and federal charges against the same individual when the cases fundamentally revolve around similar facts. This policy aims to prevent dual prosecutions that could complicate legal proceedings.

The documents marked the first time that details emerged regarding the grand jurors’ serious consideration of charges against Mr. Trump. Some jurors reportedly expressed their disappointment when a state prosecutor suggested that they should refrain from pursuing an indictment against him. The prosecutor was quoted as saying, “I have not recommended that in the draft indictment, despite clear indications from you all that there’s an interest in pursuing a charge against him.” He further acknowledged the potential letdown of the jurors, stating, “I know that may be disappointing to some of you.”

When the Arizona case was initially filed in April, it accused several of Mr. Trump’s closest allies of conspiring with a group of Republican operatives to fabricate a slate of false electors who claimed that Trump had won the state, despite the fact that Joseph R. Biden Jr. was the legitimate victor. Among those charged were notable figures such as Rudolph W. Giuliani, Mr. Trump’s former personal lawyer, and Mark Meadows, who served as his chief of staff in the White House.

While Mr. Trump was never formally charged in this case and his name was conspicuously absent from the 58-page indictment, he was referenced multiple times as “Unindicted Co-Conspirator 1,” characterized as a former president of the United States who propagated false claims of election fraud following the 2020 election.
