The head of the panel that controversially ruled that American gymnast Jordan Chiles must relinquish her Olympic bronze medal in favor of Romanian athlete Ana Barbosu has a long history of representing Romania in arbitration cases, as revealed by recent documents. This decision was made by a special tribunal convened for the Olympics by the Court of Arbitration for Sport (CAS) following a complaint lodged by Romania.

The tribunal, consisting of three members, ruled that an appeal initiated by Chiles’s coach regarding the points awarded to her in the floor exercise competition was submitted four seconds late. Consequently, Barbosu was awarded the bronze medal, which meant that Chiles was pushed down to a fifth-place finish.

The outcome left Chiles devastated; it stripped her of her only individual medal from the Games, thus placing her historic appearance on the podium—marking the first all-Black medal stand in women’s gymnastics at the Olympics—under a cloud of controversy. Following the announcement of the decision, Chiles expressed her heartbreak on social media by posting four broken heart emojis against a black background. In light of the overwhelming negative reactions, including a torrent of racial abuse, she later announced her decision to step away from social media entirely.

This ruling has sparked outrage among U.S. Olympic and gymnastics officials, who have indicated their intention to escalate their fight to the Swiss courts. The involvement of Hamid G. Gharavi, a panel member who played a significant role in the decision favoring the Romanian team, is particularly contentious. Gharavi’s longstanding relationship with the Romanian government raises further questions about the impartiality of the ruling.

In a statement on Monday, U.S.A. Gymnastics indicated that they had been informed by the court that, under its regulations, the decision is final and cannot be reconsidered, even if compelling new evidence is presented.
